These Terms of Service ("Terms") govern your access to and use of the WODLY game, website at wodlygame.com, and related services (together, the "Service"), operated by Wodly ("we," "us," "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You may use the Service only if you can form a binding contract with us and are not barred from doing so under applicable law. WODLY is intended for a general audience. If you are a minor, you may use it only with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf. Gyms, coaches, and event hosts are responsible for ensuring participants they invite are eligible and able to exercise safely.
WODLY is a game that prompts physical exercise. Exercise carries an inherent risk of injury, and by using the Service you accept that risk. You should consult a physician before beginning any exercise program, especially if you have a medical condition, are pregnant, or have been inactive. Stop immediately if you feel pain, dizziness, or discomfort.
The movements, repetitions, and workouts shown in WODLY are set by the host of each game and are for general fitness and entertainment only. They are not personalized fitness, medical, or health advice. You are solely responsible for exercising within your own ability and for your own safety and that of anyone you host.
Release. To the fullest extent permitted by law, you assume all risk of injury, illness, or loss arising from your participation, and you release and hold harmless Wodly and its owners, operators, and affiliates from any claims, liabilities, or damages arising out of or related to your use of the Service or any physical activity you undertake in connection with it.
WODLY lets a host run a fitness board game on a screen while players join from their phones to roll, complete movements, and race around the board. The Service is provided free of charge and may change, be suspended, or be discontinued at any time. We do not guarantee uninterrupted or error-free operation.
When you join a game you may enter a team or display name and, optionally, an email address. You agree to provide accurate information and not to impersonate others. You agree not to: (a) use the Service to harass, abuse, or harm others; (b) submit unlawful, offensive, or infringing names or content; (c) interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems; (d) scrape, reverse engineer, or misuse the Service; or (e) use the Service in violation of any law.
The Service may generate a shareable "recap card" summarizing your workout and let you share it. You retain ownership of the content you submit (such as your team name). By submitting content or generating a share card, you grant Wodly a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and — where you tag or share it publicly (e.g., tagging @wodlygame) — repost and promote that content in connection with the Service and its marketing. You represent that you have the rights to the content you submit and that it does not violate these Terms or any law.
Games may display sponsor logos, links, and QR codes, and the Service may contain links to third-party sites. We are not responsible for third-party content, products, or services, and inclusion of a sponsor does not imply our endorsement of you or yours of us.
The Service, including the WODLY name and logo, the game design and interface, character artwork, board artwork, text, and software, is owned by Wodly or its licensors and is protected by intellectual property laws. "WODLY" and "TRAIN. PLAY. COMPETE." are trademarks of Wodly. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.
If you opt in, we may email you your workout recap and occasional updates about new boards and matches. You can unsubscribe at any time using the link in any such email or our unsubscribe page. See our Privacy Policy for how we handle your information.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any workout is appropriate or safe for you.
TO THE FULLEST EXTENT PERMITTED BY LAW, WODLY AND ITS OWNERS, OPERATORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, LOSS, OR DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR ANY PHYSICAL ACTIVITY UNDERTAKEN IN CONNECTION WITH IT. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Wodly and its owners, operators, and affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or the rights of others.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination (including sections 2, 5, 7, 9, 10, and 11) will survive.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us to seek an informal resolution. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
